Oskaloosa Board of Adjustment meeting- September 27th

Oskaloosa, Iowa- The Oskaloosa Board of Adjustment met in regular session on Tuesday with Chairman Brian Johnson presiding. The first item on the agenda was a request from Jeff McNulty for a variance of section 17.24.030 of the city code which requires that all accessory buildings have a maximum height of 12 feet. McNulty was requesting a variance of the section so that he could complete his structure which would be at 14 feet. McNulty said that he had started construction without knowing this requirement in the zoning code.

McNulty said that it wasn’t until Building Official Dan Bolt notified them at an inspection did they become aware of the zoning requirement. Board Members Bryan Johnson and Russ Sparks both said that this wasn’t the first time they had seen this and that it probably wouldn’t be the last. The board voted 3-0 to approve the variance with staff recommendations.

The final item on the agenda was a request for a  variance from Brian Booy. Booy was requesting a variance from section 17.08.03 of the city code which requires minimum front yard setbacks of 30 feet and minimum back yard setbacks of 25 feet in areas in R-2 zoning. Booy’s request was for the purpose of building two duplexes on property he owns the corner of South D Street and 8th Ave West. The Board approved his request on a 3-0 vote.
