Oskaloosa Man Found Not Guilty Of Incest And Two Other Charges

Oskaloosa, Iowa – A Mahaska County jury found Robert Edward Hubbell Sr. Not Guilty on three charges against him Wednesday.

Hubbell had been accused of Sexual Abuse in the Third Degree, a Class C Felony, Incest, a Class D Felony, and Indecent Contact With A Child, an Aggravated Misdemeanor. Those charges stemmed from an allegation made by Hubbell’s minor daughter in February of this year.

In court documents, officers interviewed the minor where they stated in an affidavit, “Between 10:30 and 11:00 pm, she was watching a movie on her father’s bed and began to fall asleep. (Minor) stated that while she was sleeping, she felt what she thought was kissing on her chest. (Minor) stated that she thought it was a dream as she was in a state of being asleep and awake. (Minor) stated that she felt someone touching her “lower area”  and woke up to see her father standing over her.”

During questioning on the witness stand, the alleged victim stated that she has fallen asleep to the movie, ‘The Lovely Bones’, and that she had weird dreams sometimes.

During testimony on Tuesday, the defendant’s attorney Diane Crookham-Johnson asked the alleged victim about her dreams where she (alleged victim) described dreams that were adult in nature. Crookham-Johnson also questioned the alleged victim about rules in the home, and how the rules at the Hubbell home were more strict than at her mothers home.
