Letter To The Editor: No Wiggins

I have been asked by several people what these signs popping up all over the state mean that say “No Wiggins.” I have encouraged them all to turn their ballots over and vote “no” for the retention of Justice David Wiggins. Wiggins is one of the seven justices that usurped the authority of the Legislature, the Governor, and the people of Iowa on their April 3, 2009 opinion. In the case of Varnum vs. Brien, seven unelected justices thumbed their nose at the people of Iowa and committed an unprecedented crime against our Constitution.

In the Constitution, the separation of powers gives full legislative function to the Iowa Legislature, full executive power to the Governor, and limited interpretive power to the weakest branch, the judiciary. When Wiggins voted with the rest of the judges to “legalize gay marriage”, he blatantly violated his oath of office. Two years ago the people of Iowa ruled that the three justices who acted in the same way as Wiggins violated their oath of office and for the first time in history threw them out. They were held accountable and it is only fair that the good people of Iowa continue to rid the judiciary of activist judges by turning the ballot over and voting “no” on Wiggins.

In the scoring instrument used by his own colleagues, Wiggins scored an anemic 63% which is equal to a D- on a report card. This is the lowest score that any justice has ever received in over fifty years of recorded history. The next lowest was Marsha Ternus who scored in the low seventies but was voted off in 2010. This is simply unacceptable. The people of Iowa deserve to have their voice heard. Join me and take a stand. Turn the ballot over and vote no on Wiggins.
