Arterburn To Undergo Psychiatric Evaluation

Oskaloosa, Iowa – Bradley William Arterburn was represented by his two attorneys Allen L. Cook III and Kenneth A. Duker, where Duker waived the defendant’s presence at the hearing held on February 13, 2012.

There, the State of Iowa was represented by Assistant Iowa Attorney General Denise A. Timmons and did not resist the motion:

  1. The defendant’s request for a psychiatric evaluation pursuant to Iowa Code Chapter 812 is granted. The defendant shall submit to examination and evaluation, at State expense, by a physician to be revealed by the defendant on or before March 1, 2012.
  2. The evaluation shall take place at the Mahaska County Law Enforcement Center, with necessary private accommodations.
  3. The costs of the examination shall not exceed $2,000 without prior court approval.
  4. The evaluation shall be completed and filed by May 7, 2012. A status hearing is set for 9:30 a.m. on May 14, 2012.
  5. Pursuant to Iowa Code Section 812.3(2), the defendant shall be evaluated to determine if he is suffering from a mental disorder which prevents him from appreciating the criminal charge against him, understanding the proceedings, or assisting effectively in his defense, including his stated defenses of insanity and diminished responsibility.
  6. Pursuant to Iowa Code Section 812.3(2), the evaluator is authorized to provide treatment necessary and appropriate to facilitate the evaluation.
  7. Pursuant to Iowa Code Section 812.3(2), the State is entitled to a separate psychiatric evaluation of the defendant by a professional of it choosing.
  8. Pursuant to Iowa Code Section 812.3(2), case administration is suspended until further court order.

On June 19th, the Oskaloosa Police Department responded to 1106 North Fourth Street in reference to a stabbing. When officers arrived, they found a man, Robert Horovitz, suffering from multiple stab wounds. They also found Bradley Arterburn suffering from self-inflicted stab wounds. Horovitz was transported to Mahaska Health Partnership where he later died of his injuries. Artberburn was air lifted to a Des Moines area hospital and arrested upon his release from the hospital.

A criminal charge is merely a criminal charge and not an indication of guilt. All suspects should be considered innocent until proven guilty.
